Charleston Family Law Attorneys
What are Grounds for Divorce in SC?
If you are divorcing in South Carolina, you will need to meet certain requirements.
For no-fault divorces, couples must prove that they have been living separately
continuously for a full year without cohabitation.
South Carolina also provides fault-based divorces. Reasons can include:
- Adultery
- Desertion for over a year
- Habitual intoxication and/or drug use
- Physical cruelty
There is no requirement that spouses live separate and apart for one-year
prior to filing for a fault-based divorce; however, there is a statutory
waiting period of three months (or 90 days) from the date of filing until
when the divorce can be finalized for all fault-based divorces.
