What are Grounds for Divorce in SC?

If you are divorcing in South Carolina, you will need to meet certain requirements. For no-fault divorces, couples must prove that they have been living separately continuously for a full year without cohabitation.

South Carolina also provides fault-based divorces. Reasons can include:

  • Adultery
  • Desertion for over a year
  • Habitual intoxication and/or drug use
  • Physical cruelty

There is no requirement that spouses live separate and apart for one-year prior to filing for a fault-based divorce; however, there is a statutory waiting period of three months (or 90 days) from the date of filing until when the divorce can be finalized for all fault-based divorces.

At Finkel Law Firm LLC, we understand that divorce can be difficult, and we are ready to work with you through each step of the process. Our Charleston family law attorneys strive to deliver the highest levels of personalized representation, so you never feel lost or alone throughout your divorce case.

Practical Solutions for Divorce Issues

Divorce proceedings can be long and often complex. This is why it is important that you work with a trusted Charleston family law lawyer who can adequately represent your best interests, inside and outside of court.

Issues that must be addressed during a divorce include:

  • Child custody

  • Alimony

In some cases, disputes don't end with the conclusion of a divorce. Issues such as post-divorce modification of a settlement or enforcement of a court order may be required.
